Holdover Tenancy is when a person comes into possession of property legally, but wrongfully remains in possession of such. For example, where the lien holder has foreclosed and the prior owner has yet to be evicted and is a tenant at sufferance (holdover tenancy). In a lease situation, it is also called a holdover tenancy, as after a lease has expired and the owner is trying to get the tenant to move out, but before the tenant has vacated the premises.
