Deed Restrictions
Deed Restrictions are private restrictions (not public) to property that affects the owner's land use. Deed Restrictions are used to impose greater constraints on property than those imparted by governments. For example, subdivision developers and/or homeowner's associations typically establish requirements regarding improvements built on, and usage of, the property (e.g., restriction to residential use, building setbacks, height requirements, required building materials, no commercial vehicle may be stored on the premises, etc.). These restrictions help ensure a more standard appearance because they control some of the activities that take place within its boundaries. These restrictions often also an obligation to pay dues to support the activities of the homeowner's association and a lien against the property to secure payment of the dues.
