The deed is the legal document that is used as mechanism to transfer ownership of real estate. The conveyance through a deed (by gift or sale) is considered a voluntary act of an owner. The basic requirements that are generally required as part of the deed are as follows:
Both parties must be mentally competent.
It must be in writing.
It must be properly witnessed and signed by the owner (grantor).
Consideration must be listed (the amount is not important).
A proper physical and legal description must be included.
A granting clause is included that details the deed covenants.
